Terms & Conditions

Run In The Shadows and the client enters into any engagement upon the following terms: A signed agreement is required to be entered into by the parties prior to the supply of services and upon confirmation of booking. 

Booking Fee & Payment

A non refundable date reservation fee of $700 is required to hold the date of your event. No date is reserved until this fee is received. The balance of the complete package price must be paid at least 2 weeks prior to the event. If final payment is not received, Run In The Shadows will not be expected to attend the said event. Additional custom orders (prints, enlargements, frames, albums etc) must be paid in full at the time of order.

 

Schedule

Run In The Shadows must be notified immediately of any changes in the schedule or location, at least one week prior to the scheduled date of event. Notifications of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be in writing. It is the Client’s responsibility to confirm all arrangements at least 7 – 10 days prior to the event.

 

Cancellation

There is a 3 working day cooling-off period from the date of signing this contract and for any orders placed. After this time, there shall be no refund of the date reservation fee. If the event is cancelled within three months of the date, the Client shall pay the balance of the contract due to the high probability that Run In The Shadows will not be able to further book that date. Once the balance is paid, it is non-refundable, however, if Run In The Shadows s able to rebook that date, then Run In The Shadows shall refund to Client an amount equal to 15% less than the invoiced amount less any difference between the invoiced amount and the fee paid to Run In The Shadows in connection with the replacement booking if the fee for the replacement booking is less than the fee under this contract (excluding the booking fee). The 15% is to cover the time that has been put in before the wedding day. Any other arrangements shall be discussed between the Client and Run In The Shadows. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform Run In The Shadows of the cancellation.

COVID 19 / CORONAVIRUS / Pandemics / Force Majure / Natural Disasters / Global Events

If due to any of the above (including Covid19), that is an event out of the photographers hands, the wedding is unable to go ahead due to lockdowns or other issues in New Zealand Run In The Shadows will move your date to any other date that they have available within 12months of the original date at no extra cost. If you have booked internationally and cannot travel we will move your date to any other date that they have available within 12months of the original date at no extra cost. If you want to move outside the 12months there may be increased costs due to price increases by Run In The Shadows If you choose to cancel, your date reservation fee is non-refundable as this covers reserving the date and work up until the day of your wedding. 

 

Responsibilities

Unless agreed upon in advance, Run In The Shadows shall be the exclusive photographer retained for the event. The Photographer may bring one assistant at her discretion. Videographers and other vendors as well as semi professional photographers must not obstruct or interfere with the official photography and are not allowed to take any still photos during formal sessions namely, the scheduled wedding party shots. Wedding guests may take photos, but it is the responsibility of the Client to prevent family and friends from interfering with the Photographer’s duties. Run In The Shadows is not responsible for compromised coverage due to causes beyond her control such as other people’s camera or flash, the lateness of the bride, groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. The Photographer is not responsible for existing backgrounds or lighting conditions, which may negatively impact or restrict the photography coverage. The Run In The Shadows shall carry out this assignment with due and professional diligence. There are other elements beyond the Photographer’s control including faulty material, equipment failure, damaged or loss of memory cards in transit between the studio and professional laboratories employed by Run In The Shadows. In the event elements beyond the control of Run In The Shadows in an incomplete production, then Run In The Shadows liability shall be limited to the fees paid to Run In The Shadows by Client. It is our top priority and all measures are taken that all risks are minimised.

 

Liability

In the unlikely event of severe medical, natural, legal, or other emergencies, it may be necessary to retain an alternate photographer, Run In The Shadows will make every effort to secure a replacement photographer that is able and willing to provide a similar package as chosen in this contract at a similar price. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package, including refund of the date reservation fee.

 

Harassment

Run In The Shadows agrees that it will conduct itself in a manner befitting professionals while in attendance at each event. Ensuring the appropriate behaviour of all guests and other persons at the wedding and other events covered by Photographer shall be the responsibility of the Client. In the event that Run In The Shadows experiences any inappropriate, threatening, hostile or offensive behaviour from any guest or other person at the wedding or other event (including, but not limited to, unwelcome sexual advances, and verbal or physical abuse) then the following process shall be followed: first offence: a verbal warning will be issued to a family member of the client; second offence: the offending person will be required to leave the wedding or event; third offence: Photographer will end wedding coverage immediately and leave the event. The Photographer shall be entitled to retain all monies paid hereunder and client agrees to relieve and hold Photographer harmless as a result of incomplete wedding or event photography coverage. Any of the Photographer’s equipment damaged in the process will be the Client’s responsibility to cover the excess on the insurance claim.

 

Coverage

Run In The Shadows will provide coverage for the dates, locations and continuous hours specified in this Agreement. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. Any lists supplied will be used for organisational purposes only. Images determined by the Photographer to be substandard or duplicated may be edited out. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Such selection shall constitute all images that will be made available to Client.

 

Image Processing/Printing

Unless agreed upon prior to any editing work, high-resolution files and/or proof sets may contain a mixture of colour, black and white, and selective colour images. Limited colour correction and/or retouching are included at Photographer’s discretion. Client may request further changes for an additional charge. Photographer is not responsible for any prints that are not ordered directly from her. For best results, clients with the high resolution files should order their prints through a reputable lab.

 

Artistic Style

The client acknowledges that it is familiar with Run In The Shadows portfolio and is requesting services with knowledge of Run In The Shadows style, that the work of Run In The Shadows is constantly evolving, that Run In The Shadows services are of unique and artistic nature, that the photos may be different from photographs taken by Run In The Shadows in the past, and that in creating the photos, Run In The Shadows shall use their personal artistic judgment to create images consistent with the vision of the wedding, which vision may be different from the client’s. Accordingly, the client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria.

 

File Release, Copyright, Reproduction and Usage

The client is granted a perpetual, irrevocable, worldwide and royalty-free license to print and use all photographs from the event, photographed by Run In The Shadows, for personal use only, including printing, in e-mails, thank you cards, photo albums, and similar such products. If posting on any website, including Facebook, it is encouraged to give credit to Run In The Shadows, with a link to her website whenever deemed appropriate. The client cannot sell the images or use them for commercial purposes, such as in magazines or other advertising, and they cannot alter the images in any way without permission from Run In The Shadows, except to reduce to a smaller size for web. Client further agrees not to supply images to any professional third parties, (including vendors or professionals associated with the wedding) without permission from Run In The Shadows which shall not be unreasonably withheld. All photographs taken by Run In The Shadows including those taken by a 2nd Shooter remain the property of Run In The Shadows. Client hereby waives any claims for ownership, income, editorial control. All images are available for Run In The Shadows to use unconditionally for marketing purposes including but not limited to websites and magazines. Client waives any right to inspect or approve the photograph(s), finished version(s) incorporating the photograph(s), or the use to which it may be applied, including written copy that may be created and appear in connection therewith. The Photographer will not make reproductions for other use, or sell the images commercially, without first making the client aware.

 

Delivery Times

Delivery of the images shall occur within 8-12 weeks maximum of the event date unless prior arrangement has been made in writing and delivery of the pre-booked digital album layout shall occur no later than 4 months after the event. Due to the fact that printing and production is outside the control of Run In The Shadows, the Client will not hold Run In The Shadows responsible for late or delayed albums.

 

CD/DVD Storage

Due to the lack of information about how long DVDs and flash drives can hold information, Run In The Shadows recommends you back up your images on another media format other than CD/DVD. Run In The Shadows also recommends making multiple copies of CDs/DVDs/USB’s every year to insure the images for years to come. Run In The Shadows cannot be held responsible for the failure of CDs/DVDs/USB’s due to mishandling. It is the Client’s responsibility to keep several copies of any CDs/DVDs/USB’s in more than one location and back the images up on another format such as a hard drive. Run In The Shadows has no obligation to retain archives, and preservation of the digital files shall be the sole responsibility of the clients once the digital copy is delivered.

 

Event Food Service

A meal is required for events 7 hours and more for the Photographer and assistant. If less than this or if no meal is provided, it is understood that the Photographer will leave the event to purchase a meal.

 

Miscellaneous

This agreement is the total agreement and supersedes all prior verbal agreements.

 

PROVISIONS OF SERVICES AGREEMENT

The total service fee is as agreed from accepted quote and includes the services outlined in the package chosen. A date reservation fee of $700 is due upon booking to secure the date of your wedding and is non-refundable. The remaining balance of the total service fee is to be paid two weeks prior to the event. No rights are granted until payment is made in full. The fee may be non refundable in case of cancellation or date change by client.
